Terms & Conditions

1. For confirming a charter (EC-130T2 Helicopter), we, DADACHANJI AVIATION PRIVATE LIMITED (“Operator”) will require payment to be made 100% advance, based on the indicated flying time, charter rate (₹ per hour), landing charges, ground handling charges, overnight stay, waiting charges, hotel accommodation, transportation etc. However, the actual billing and the adjustment of payment made/amount payable would be on actual basis at closure of each flight.

2. A minimum charge for two (02) hours of flying time will be charged on every booking. The flying/block time quoted in the quotation is approximate and may vary from flight to flight. The final settlement of bills shall be done on the basis of actual hours flown or two (02) hours, whichever is higher (from our base at Juhu, Mumbai and back to base). Any flying time above two hours shall be rounded off to the next half hour.

3. Crew Layover in case of prolonged halts during the course of a single day at a particular station, the “Charterer” will make suitable arrangements for lodging, boarding (at a 5-star hotel); local transport or Operator will make the necessary arrangements at an additional cost to the Charterer.

4. Above flight timings are indicated under NIL wind conditions, and billing will be based on the actual time taken for the flight, measured from “rotor start to rotor shutdown”. Timings may vary depending on weather, wind, fog/visibility conditions, and flight schedules are subject to change or diversion due to weather conditions, flight safety, and operational restrictions.

5. Any delays in departure due to security screening/ATC would not be attributable to the Operator.

6. Any watch hour extension, landing, ground handling and parking charges levied by the airport/authority will be billed separately.

7. SATCOM, if applicable, will be charged on an actual basis, depending upon the usage.

8. Confirmation of charter to uncontrolled airstrips should be given before 12 working hours from the departure time.

9. The quotation given will be valid subject to availability of aircraft/crew and is subject to change due to the change in hourly rate of the aircraft, handling &; landing/parking charges at the airports of operation etc.

10. The Operator shall always have the right to, at its sole discretion, decline or refuse carriage of any passengers, cargo, baggage, or luggage that intends or is intended to board or is to be loaded onto its helicopter, as well as regards the suitable dressing or packaging thereof, on account of legality, safety, space, operational capacity, law, rules and regulations in force from time to time.

11. In case of foreign passengers, we will require the Names, Nationality, copies of valid Passport, Visa / OCI Card well in advance to obtain permissions as per the laid down guidelines.

12. Operator will not be responsible for passengers carrying any contraband or prohibited items and or involved / indulging in any illegal activities. Any act or activity of the passenger that is banned, illegal or unlawful or that is dangerous for the flight crew, passengers, helicopter, hangar, hangarage and or cargo, is prohibited and passenger will be entirely responsible for the same. We shall not be liable for any compensation civil or criminal liability whatsoever for any accident/ crash/resulting in loss to human life or loss of cargo etc., beyond insurance cover in the event of such eventuality.

13. The Operator shall not be liable for any loss, damage, delay or any other liability, and the Charterer shall ensure to make prior arrangements and take out such insurance as shall be necessary to cover any loss, damage, delay or other liability arising in relation to itself, its clients, staff, employees, agents, passengers of whatever designation, cargo and or luggage.

14. The Operator shall not be responsible or liable for indirect, consequential, incidental or punitive loss, damage or expenses (including but not limited to business interruption, lost business/profit, or lost savings).

15. Baggage Restrictions: One hand baggage per passenger not exceeding 3 kgs. will be permitted.

16. The Operator shall be entitled and at liberty to make interim stops for fuel, supplies, repairs, maintenance, and take whatever steps it deems necessary for the protection of itself, its crew, its helicopter, passengers and or cargo, and it shall not be held liable for any loss, damage or expense for any resultant delay or inability to perform the service to conclusion.

17. A flat hard ground of minimum 30 meters diameter, without any obstructions (e.g., High rise buildings, high trees, high tension wires etc.) around the area, especially on approach path is required, for landing of helicopter. The landing area should be marked with an “H” inside the circle. The location of the landing site, preferably with a sketch and co-ordinate (i.e., latitude and longitude) must be provided. For landing on government property /public places, a written
permission from the District Collector and the Local Police, or other applicable authority must be obtained. For landing on privately owned property, permission from the owner of the property will be required and all arrangements for landing / take-off will have to be made by the owner and that all necessary co-ordinations have been made with the local authorities, i.e., with the District Collector and District Police. Helicopter operation is from sunrise to sunset only.

18. Revision of Charter Rates: The Operator reserves to itself the right to revise the charter rates without prior notice, in case there is an increase in operational costs due to increase in fuel prices, landing, navigational / parking charges, govt. taxes, maintenance cost etc.

19. The Pilots of each flight have the complete authority to delay or cancel flights, if weather conditions etc. indicate that it is not advisable to fly the aircraft under such conditions.

20. These terms and conditions are governed by the laws of India and competent courts of Mumbai shall have exclusive jurisdiction.

21. PAYMENT TERMS:
a) Flight will be treated confirmed only after receiving 100% advance by Cheque/DD in favour of DADACHANJI AVIATION PRIVATE LIMITED or through RTGS/NEFT to our bank account.
b) All incidental charges, government taxes and levies will be paid by the customer. GST will be charged on the billing amount at applicable rate.

22. CANCELLATION:
a) In the event of cancellation, the following charges shall apply:
i. 100% of the charter cost if the flight is cancelled within 24 hours of the scheduled
departure.
ii. 50% of the charter cost if the flight is cancelled before 24 hours prior to the
scheduled departure.

b) A no show of the passenger(s) for two (02) hours after ordered departure time will be considered as a cancellation announcement.

23. FORCE MAJURE:
The Operator shall not be held responsible for the non-operation of the charter for any unforeseen reason(s), including but not limited to (1) Adverse weather conditions; (2) Poor visibility; (3) Non-availability of clearances from ATC, Defense Authorities, or Civil Administration; (4) Technical Problem. If the flight cannot depart from the originating station due to any of the above reasons, the full amount paid will be refunded. The Operator will always obtain weather updates for the destination prior to departure. However, if there is a sudden deterioration in weather conditions en route or at the destination, resulting in the aircraft being unable to land and requiring a return to the point of origin or diversion to some other airport, the
actual flying time will be chargeable. Any balance amount, if applicable, will be payable by the customer or refunded by the Operator. The Operator shall not be responsible for any technical snag that develops in the aircraft which cannot be rectified within the time limit, thereby affecting the operation of the flight.
